If you’ve been pulled over in New York for drunk driving, you could be charged with one of several different offenses:

Driving while Intoxicated (DWI): You can be arrested for evidence of intoxication or a blood alcohol level of 0.08 or higher.

Driving while Ability Impaired by Alcohol (DWAI): You can be arrested for evidence of impaired ability and a blood alcohol level of 0.05 to 0.07.
